3. Estimates & Quotations

Preliminary Only: All estimates provided via our website contact form, phone, or email are preliminary estimates only and are not binding quotes.

Written Quotes: A formal written quote is provided only after an in-person or virtual site assessment by our team.

Quote Validity: Written quotes are valid for 30 days from the date of issue unless otherwise stated in writing.

Free & No Obligation: All estimates are provided free of charge and carry no obligation to proceed with our services.

4. Service Agreements & Payment Terms

All construction and renovation work performed by Cruzz Construction is governed by a written service agreement signed by both parties prior to commencement of any work.

Overdue payments are subject to interest at a rate of 1.5% per month (18% per annum) from the date the payment was due.

5. Scope of Work & Change Orders

The scope of work is defined in the written service agreement. The following applies to any changes after work has commenced:

  • Any additions, modifications, or reductions to the agreed scope of work requested by the client must be documented and agreed upon in writing as a change order before additional work is performed.
  • Change orders may affect the project timeline and total cost. We will provide a written quote for all change orders prior to proceeding.
  • Cruzz Construction will not be held responsible for delays or cost increases resulting from: undisclosed or unforeseen site conditions, changes requested by the client, permit delays beyond our control, or material supply chain delays.

6. Permits & Building Code Compliance

Where required by the City of Hamilton, the Ontario Building Code, or any applicable municipal regulation, Cruzz Construction will obtain the necessary building permits on behalf of the client. Permit fees are passed through to the client at cost. All work is performed in compliance with the Ontario Building Code and applicable City of Hamilton bylaws. The client is responsible for ensuring that any work on strata or condominium properties has received the required approvals from the relevant corporation.

7. Workmanship Warranty

Cruzz Construction warrants all workmanship against defects for a period of one (1) year from the date of project completion and final payment.

This warranty covers defects in workmanship only and does not cover:

  • Normal wear and tear over time.
  • Damage caused by misuse, neglect, or abuse by the client or third parties.
  • Modifications or alterations made by others after project completion.
  • Damage caused by events beyond our control (e.g., floods, extreme weather, acts of nature).
  • Pre-existing conditions that were not disclosed to us prior to project commencement.

Materials used in our projects are subject to the manufacturers’ warranties, which we will facilitate on your behalf where applicable. Warranty claims must be submitted in writing to info@cruzzconstruction.com within the warranty period.

8. Insurance & Liability Coverage

$1M–$2M coverage on all residential and commercial projects.

WSIB Coverage

Workplace Safety and Insurance Board coverage for all employees and contractors on every job site.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Cruzz Construction’s total liability to any client arising from or related to any project — whether in contract, tort, or otherwise — shall not exceed the total amount paid by that client for the applicable project. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of use, even if we have been advised of the possibility of such damages.

10. Cancellation Policy

Cancellation Timing Outcome
14+ days before start date Deposit refunded minus any costs already incurred for materials, permits, or scheduling.
Less than 14 days before start Deposit is non-refundable. No further charges apply if work has not commenced.
After project has commenced Client is liable for all work completed, materials ordered, and labour costs to the date of cancellation.

11. Client Responsibilities

To ensure the smooth and timely completion of your project, the client agrees to:

  • Provide accurate and complete information about the property and the scope of work required.
  • Disclose any known pre-existing conditions, structural issues, or hazardous materials (e.g., asbestos, mold) prior to project commencement.
  • Ensure reasonable access to the work area during agreed working hours.
  • Make timely decisions regarding material selections, change orders, and approvals to avoid project delays.
  • Make all payments by the due dates specified in the service agreement.

12. Dispute Resolution

In the event of any dispute arising from or relating to a project or these Terms, both parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may refer the dispute to a mediator mutually agreed upon by both parties. Only if mediation fails will either party pursue formal legal proceedings.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles. Any disputes not resolved through negotiation or mediation shall be subject to the exclusive jurisdiction of the courts of Hamilton, Ontario.

14. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. The updated version will be posted on this page with a revised “Last Updated” date at the top of the page. Your continued use of our website or services after any changes constitutes your acceptance of the updated terms. We recommend reviewing this page periodically.
