What does a renovation or addition in Waterdown need to check first?

A project in Waterdown first checks which zoning by-law governs the lot: some properties are still under the former Town of Flamborough by-law 90-145-Z rather than Hamilton's By-law 05-200. Lots in the Grindstone Creek valley need Conservation Halton's permission under Ontario Regulation 41/24, and lots near the escarpment can need a Niagara Escarpment Commission permit. Cruzz Construction, a Hamilton general contractor, works in Waterdown.

Which zoning by-law applies in Waterdown?

Waterdown is part of the former Town of Flamborough. The City of Hamilton's zoning page for the former communities says properties not yet brought into By-law 05-200 are still regulated by their former by-laws, including the Town of Flamborough Zoning By-law 90-145-Z. The City's interactive zoning map shows which applies to an address, and that by-law sets how large an addition can be and where it can sit.

Does Grindstone Creek bring a Conservation Halton permit?

It can. Conservation Halton says its permission is required to develop in an area it regulates under Ontario Regulation 41/24: watercourses, flood plains, valley lands, steep slopes, wetlands and hazardous land. Development includes buildings, decks, retaining walls and grading. Its policy document places the whole Grindstone Creek watershed in its jurisdiction. Conservation Halton asks owners to contact staff before applying, and its permission does not replace the City's.

Does the escarpment add a permit?

Waterdown sits at the top of the Niagara Escarpment. On land in the Commission's Area of Development Control, a development permit from the Niagara Escarpment Commission can be needed before the City issues a building permit, so a lot near the brow is checked first.

What about the older houses in the village?

A designated heritage property needs a City of Hamilton heritage permit before a building permit is issued, when the work is likely to affect its heritage attributes. Check the City's heritage list for the address before planning an addition or new windows on an older Waterdown house.

What should a Waterdown brief include?

The address, the zoning by-law the City's map shows, whether the lot backs onto a creek or valley, photos and any drawings. Home additions and whole-home renovations set out the approvals in order, and the permit guide covers the City steps.

Send the drawing set and the dates for commercial work. For a home, the drawings or a sketch, a few photos and what you want built is enough to start.
